Defendant-appellant Delmar Garrett, proceeding pro se, appeals the district courts denial of his 28 U.S.C. 2255 motion to vacate, set aside, or correct his sentence. We vacate the district courts order and remand for further proceedings to resolve the factual issue of whether Mr. Garrett had requested his attorney to file a notice of appeal. If he actually made such a request and counsel disregarded it, Supreme Court and Tenth Circuit authority dictates that he is entitled to a delayed direct appeal of his criminal sentence.
