Argued September 11, 1998 Defendant Grant Vahovick appeals the sentence he received after pleading guilty to one count of possession of a prohibited object in prison. Vahovick challenges the district court's determination that he committed a crime of violence and, therefore, qualifies as a career offender under the Sentencing Guidelines. The defendant also challenges the district court's decision not to consider a downward departure under the Sentencing Guidelines based on the threatening conduct of his victim. For the reasons stated herein, we remand for resentencing.
